By confirming a booking via email, WhatsApp, or any other digital channel, the client acknowledges having received, read, and accepted these terms. In case of any contradiction between the summary below and the full General Terms and Conditions, the latter shall prevail.

My Artistic Approach:
As a photographer, I often take on the role of art director. Clients typically grant me carte blanche within a pre-agreed framework, based on their trust in my expertise and signature style.
The projects showcased on this website are the result of this mutual trust and a thorough discussion of the project's content and intended use.

Process & Selection:
No Tethering: During the shoot, I do not use tethering (viewing images directly via a laptop). This allows for a more fluid and focused creative process.
Pre-selection: Within 2 to 3 business days after the shoot, I typically share an unedited pre-selection.
Final Choice: The final images are chosen from this selection, either solely by the client or in close consultation.
Raw Material: It is strictly prohibited to use, publish, or share unedited or raw material through any channel. Sharing or publishing unedited material is considered a copyright infringement.

AI & Intellectual Property Policy:
I maintain a strict policy regarding the use of Artificial Intelligence in combination with my material. Without explicit, prior written consent from me and—where applicable—the model(s) and/or their agency, the client and/or third parties are not permitted to: Generate or Manipulate: Generate, manipulate, or edit my material using AI; Training: Use my material for AI training, testing, or machine learning algorithms; Derivatives: Create digital representations, deepfakes, avatars, or other derivatives. Any AI-related use must be reported and registered in advance. Violation of this policy results in direct financial liability and penalties as defined in Article J of my General Terms and Conditions.

PRIVACY POLICY

This Privacy Policy explains how Armandobrancophotography.com (referred to as "we," "us," or "the Photographer") collects, uses, and protects your personal data in accordance with the General Data Protection Regulation (GDPR).

1. Data Collection & Purpose
We collect and process personal data only when necessary for the following purposes:

• Bookings & Communication: To process your inquiries, schedule shoots, and maintain professional contact (Name, email, phone number).
• Execution of Services: To deliver the agreed-upon photography services, including the creation and storage of visual content (your image/portrait).
• Financial Administration: To process invoices and comply with Dutch tax regulations (Address, VAT number, payment details).
• Portfolio & Marketing: We may use selected images for our portfolio, website, or social media, but only with your explicit consent or based on a signed model release/agreement.

2. Data Storage & Security
Your data and high-resolution images are stored on secure, password-protected systems and encrypted cloud storage to prevent unauthorized access, loss, or theft.
3. Retention Periods
We do not store your data longer than strictly necessary:

• Client Records: Stored for 7 years to comply with the statutory retention period required by the Dutch Tax Authorities.
• Visual Material (Photos): Raw and edited files are kept in our archive for a period of 5 years to allow for reprints or lost file recovery, unless a different term is agreed upon.
• Inquiries: Data from potential clients who do not book a session will be deleted after 1 year.

4. Sharing with Third Parties
We only share your data with third parties when essential for our service, such as:

• Cloud storage providers for gallery delivery (e.g., Pixieset, WeTransfer).
• Accounting software for invoicing.
• External printing labs (if physical prints are ordered).
  We ensure these parties are also GDPR compliant.

5. Data Breaches
In the unlikely event of a serious data breach, we will notify the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) and the affected individuals within 72 hours of discovery.
6. Your Rights
Under the GDPR, you have the following rights:

• Access & Correction: You may request to see or update the data we hold about you.
• Erasure: You may request the deletion of your data (the "right to be forgotten"), provided it does not conflict with legal tax obligations.
• Objection: You may object to the use of your images for marketing purposes at any time.
• Complaints: You have the right to lodge a complaint with the Autoriteit Persoonsgegevens.
